Utility Model Registration and Application Process

Due to the Law No.551  related with the Protection of the Patents; once an invention is applied , it is forwarded to examination for 3-5 months time.

If there is not any grounds of refusal, the application is published on the monthly  Patent Bulletin for 3 months.

The 3 months publication period is also opposition term for 3rd parties .

If there is not any opposition at the end of the publication period, the registration decision is issued.

The 3rd parties can file the opposition as it is not new  and add evidence documents.

The examiner asks the applicant to file arguements about the opposition or Due to the Law of Protection of Patents , the applicant has a right to file request fort he utility model certificate without filing arguments.

Due to the applicants request, the registration decision has been issued and the certifcate has been prepared.

The opposing party has a right to file a law suit in 2 months time .

The time to obtain registration is nearly about 10-12 months from the application date.
